The Promotion is organized by Tommy Hilfiger Europe B.V. a private limited liability company construed under the laws of the Netherlands (the “Promoter”) and will be governed by these terms and conditions (the “General Terms”) and the additional terms for the specific promotion (“Promotion Terms”), together the “Terms”.

Scope of the Promotion:

The Promotion aims to promote Tommy Hilfiger’s brand and products, which will not suffer any price increase as a result of the raffle.

Promotional Period:

The Promotion will run between 26 September 2024 (at 00:01) and 2 October 2024 (at 23:59)

Prize:

By entering the Promotion, Participants have a chance to win:

  • Brand ambassador welcome package;

  • 4 (four) total looks throughout the year (including outerwear, top, bottom, shoes and/or accessories);

  • Invitation to local Tommy Hilfiger brand events at O&O stores;

  • Invitation to other Tommy Hilfiger sponsored events;

  • Transportation to/from events where needed, as well as accommodation and meals (to the discretion of Tommy Hilfiger);

  • Travel assistance where needed.

Winners travelling will need to have valid passport or other valid travel documentation (visa support is not included into the prize).

Tommy Hilfiger Europe B.V. is neither a tour organizer nor a travel agent. The package tour services will be provided by third-parties. More information on the tour organizer and further details will be provided directly to the winner of the prize.

Prize value:

The Prize has a maximum total value of EURO 2250, per prize/ Winner. Approximately EURO 1500 will allocated towards the 4 total looks throughout the year. The remaining amount of approximately EURO 750 will be reserved for the welcome package and (transportation to and meals during) events;

Participation criteria

To enter the Promotion, Participants have to:

  • Be a resident of one of the above mentioned regions;

  • be(come) a Tommy Together member; and

  • Enter the drawing by answering one (1) question: “What is your favourite piece of Tommy Hilfiger clothing and why? “

  • People travelling will need to have valid passport or other valid travel documentation (visa support is not included into the prize);

  • By participating, Winner agrees that PVH Europe B.V. its affiliates and designees may use, worldwide and at no consideration, all photographs and videos that are made of the Winner in relation to the Prize, and/or in which the Winner is depicted, as well as the content the Winner has provided in the form of a quote, interview, blog entry or similar, for all purposes (such as commercial, editorial and PR etc.) and through all media (such as online/digital, social media, offline, TV, etc.). This authorization is governed by Dutch Law.

Selection of winner

The Winner will be selected by a jury composed of associates on the Tommy Hilfiger Membership and Marketing teams.

Criteria the jury will use to select the winner:

  1. Relevance to the brand: How well do the answers reflect the essence and energy of the Tommy Hilfiger brand?

  2. Creativity and originality: Do the answers present a unique perspective and thoughtful analysis?

Winner Selection Process:

  1. All entries will be analyzed by a jury based on established criteria.

  2. The jury will pre-select the best entries based on the quality of the answers.

  3. The jury will convene to discuss the selected entries and make the final selections.

  4. The winner will be selected by unanimous decision of the jury and announced through official channels.

GENERAL TERMS AND CONDITIONS FOR PRIZE PROMOTIONS

  1. The Promotion is organized by Tommy Hilfiger Europe B.V. a private limited liability company construed under the laws of the Netherlands with registered office address at Danzigerkade 165, 1013 AP, Amsterdam, the Netherlands, company registration number 33290078 (the “Promoter”) and will be governed by these terms and conditions (the “General Terms”) and the additional terms for the specific promotion (“Promotion Terms”), together the “Terms”. Tommy Hilfiger Europe B.V. is the independent controller for all processing of personal data collected for the purpose of the Promotion and will process the personal data in accordance with our privacy notice (available at: https://cz.tommy.com/terms-and-conditions#PRIVACY_NOTICE).
  2. A consumer entering the Promotion (hereinafter called “Participant”) agrees to have read and understood the Terms and will be bound by them. The Promotion Terms shall prevail over the General Terms.
  3. The Promotion will run in the Region specified in the Promotion Terms. The Promotion shall be void where or in as far as prohibited or restricted by law.
  4. By participating in this Promotion during the Promotional Period, Participants have a chance to win the Prize. The Promotional Period, the Prize and its value is further specified in the Promotion Terms. The prize award is non-transferable and no cash redemption or prize substitution allowed, except at Promoter’s sole discretion or as provided herein. No cash alternatives for the Prize will be offered. If due to circumstances beyond the Promoter’s control the Promoter is unable to provide the Prize or any part of it, the Promoter reserves the right to award a substitute prize of equal or greater value.
  5. In addition to the participation criteria set out in the Promotion Terms, the Participant has to enter the Promotion by agreeing to the Terms and has to be at least eighteen (18) years of age at the date of entry of the Promotion. The Promotion is not open – directly nor indirectly – to employees and immediate relatives of employees of the Promoter, its subsidiaries or affiliated companies, or any other person professionally connected with the Promotion.
  6. Any Winner will be informed of the fact that they won via an email from the Promoter to the email address shared by the Participant and the names of the Winners will be published on the https://cz.tommy.com/brand-ambassador-2024-raffle that communicates the Promotion.
  7. Unless otherwise stated in the Promotion Terms, the Participants will be ranked in order to select the Winner. Those who follow in the ranking, after the first name or winner, will be considered reserves in order of ranking in case of unavailability of the winners or in the absence of the required requirements. The Winner needs to respond to the Promoter within 72 hours after the first notification to confirm his/her acceptance of the prize. If such response has not been received by the Promoter within the said time, the Promoter has the right to choose another Winner applying the ranking order. The Promoter reserves the right to select an alternative winner in the event that the Promoter has reasonable grounds for believing that a selected Winner has contravened any of these Terms. Any alternative Winner will be selected applying the same criteria as that used to select the original Winner.

The Participant has also rights from defective performance according to law. Justified rights from defective performance will be resolved no later than 30 days after their delivery.

9. Disputes may be resolved out of court by alternative dispute resolution procedure. In such a case, the Participant may turn to the Czech Trade Inspection Authority on the following website: https://www.coi.cz/en/information-about-adr/.

10. The Winner, if a tax resident in the Winner’s local country, is responsible for complying with local tax obligations, unless local law determines otherwise. If winners of a Prize have any questions related to specific tax obligations, please contact TommyTogetherEurope@tommy.com.

11. The Promoter shall not be responsible for technical errors in telecommunications networks, internet access or otherwise preventing entry to this Promotion.

12. No waiver of any rights by the Promoter or any Participant will be taken as a waiver of any other rights it may have. For example, if the Promoter waives its right to complain about a particular breach of the Terms by a Participant, it does not prevent the Promoter from complaining about other breaches.

13. Any personal data collected by Promoter from Participants (e.g. name of Winner), will be used solely in connection with this Promotion in accordance with our privacy notice (available at: https://cz.tommy.com/terms-and-conditions#PRIVACY_NOTICE).

14. The Participant, being a consumer, has the right to initiate an out-of-court dispute resolution online through the ODR platform available on the website https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.trader.register&lng=EN.

15. The Terms shall be governed by and construed in accordance with the laws of the Netherlands, unless mandatory local laws prevail and any disputes shall be subject to the jurisdiction of the competent courts in Amsterdam, the Netherlands, unless mandatory local laws prevail.
